wrongful termination

Well I was called in and fired last Friday...

(I work in the mortgage industry for another of those crooked, corrupt companies)...

My former boss filed a large lawsuit against the company and they fired me and another guy JUST because we were affiliated with my former boss and were listed in the lawsuit as witnesses.

Meeting with an attorney today...and hope another one in a day or two..

They didn't pay me what they owe me.

also considered age discrimination.

the owner ADMITTED I did nothing wrong it is all due to the lawsuit...

isn't life grand...

So I am really scrambling...had to file for unemployment and also social security which I hadn't planned on doing...will reduce my benefits over life...

Wish me luck and help me land a job....LOL...

At this point, will do manual labor if necessary - want to get away from the mortgage industry...

Talked to one attorney this am...said I am out of luck as CA is an at will state - can hire and fire with no recourse...

Like R1Lover said, what about basing your case on discrimination? Lawyers are great for coming up with some kind of bs to build a case on, you'd think at the very least they could get the company to agree to a settlement, especially if they didnt pay you what you are already rightly owed.

Lawyer said there isn't enough money involved to be worth anyone's trouble...they paid me $11.50 an hour and the commissions we are hassling about don't amount for $1,500 - $4,000

As to legal actions, as stated it's an at will employment. Also, think of it this way...


You are considered a hostile witness to the company. Therefore, it's in their best interest to let you go so that you can't continue to spy on them and report back on anything associated to the case. Perfectly legal.

Any chance you are eligible for accrued vacation or sick pay? What about a severance package based upon length of employment? I know you can file for unemployment, but Social Security? Typically, that's only if you have medical conditions preventing you from being able to work and are no longer able to work before your retirement age.

Tough times indeed. Best to you and your daughter in both issues.

Thanks...dude...company has no vacation pay, no sick pay and no medical benefits or severance....period....

Have applied for Social Security and will get that in May...unemployment too...

Just don't know what the universe has for me but am pretty much at the end of my rope anyways...

Colorado is another "No Reason" state meaning they can fire you for no reason at all... But if they told you why that can be used in a lawsuit..
